LIFE IMPRISONMENT FOR BLOEMFONTEIN MAN CONVICTED OF BRUTAL MURDER
Bloemfontein, Free State – The National Prosecuting Authority (NPA) has successfully secured a sentence of life imprisonment against Nkululeko Magwa (20), who was convicted of the murder of 24-year-old Thabo Buti in Kagisanong, near Bloemfontein.
The Bloemfontein Regional Court convicted Magwa based on common purpose, rejecting his defence that he had been asleep at home when the murder was committed. The trial commenced on 24 August 2026, and the conviction was handed down on 27 August 2026.
The court heard that during the early hours of 11 October 2025, Buti and a female companion were walking to catch a taxi when they were confronted by three men. Buti attempted to flee but was chased and apprehended by the group at a nearby street corner. When the assailants returned with him to where the female witness was standing, he had already sustained stab wounds.
The attackers then forced both victims to kneel. In a chilling sequence of events, they ordered Buti to remove his shoes and pray. Before he could complete his prayer, Magwa stabbed him. Buti succumbed to his injuries at the scene.
The State also led evidence from a male witness who had been jogging in the area when he witnessed the attack. Attempting to intervene, he confronted the assailants and pushed them away from Buti. During the ensuing altercation, Magwa attempted to stab him. Although the witness managed to seize the knife, he sustained a cut to his hand. The attackers subsequently fled the scene.
A significant challenge facing the prosecution was the identification of Magwa by the female eyewitness, who had consumed alcohol earlier that morning. Despite this, the State successfully proved its case through the totality of the evidence presented, including the corroborating testimony of the male witness, who personally knew Magwa and positively identified him as one of the perpetrators.
During sentencing proceedings, State Prosecutor Amorè Coetzee presented evidence in aggravation of sentence, highlighting the devastating and far-reaching impact of the murder on Buti's family.
The court heard that Buti was the only child of his mother and stepfather, both of whom were reportedly in poor health. Following their son's murder, they struggled to cope with the trauma and emotional devastation. Their health deteriorated significantly, and both passed away earlier this year.
Family members further told the court that they remain deeply traumatised by Buti's murder and the subsequent loss of both parents. They described a family still grappling with profound grief and the enduring consequences of the tragedy.
In imposing a sentence of life imprisonment, the court found that Magwa had shown no remorse for his actions and that no substantial and compelling circumstances existed to justify a lesser sentence.
The NPA welcomes the sentence, which reflects the seriousness of the offence and underscores the justice system's commitment to holding perpetrators of violent crime accountable. The successful prosecution demonstrates that those who commit senseless and brutal acts of violence will face the full might of the law.
The NPA remains steadfast in its commitment to ensuring that perpetrators of serious and violent crimes are brought before the courts and held accountable for their actions.
Such crimes not only claim innocent lives but also inflict lasting trauma on families and communities.
