JUDGEMENT AGAINST MR JULIUS MALEMA ON FIREARM TRIAL

The Economic Freedom Fighters (EFF) notes the judgment delivered today in which the President and Commander-in-Chief of the EFF, Julius Malema, has been found guilty in the firearms case by the East London Magistrate Court. This matter, relating to an incident at the EFF’s 5th Anniversary celebrations in the Eastern Cape in 2018, has been maliciously pursued for more than seven years. 

Throughout this period, the case has been dragged through the courts, not because of compelling evidence, but because of the political agenda driving it. It is no surprise that the state has pursued this matter to this point, for there have always been coordinated attempts to discredit and sabotage the EFF and its leadership. from the moment CIC Malema and the EFF fearlessly confronted corruption in the highest offices, demanded land expropriation without compensation, and exposed the capture of the state by both local and global capital, the system has sought to silence him by any means necessary. 

We are not shocked by the outcome of this judgment, because the racist right-wing Donald Trump has openly issued an instruction for the arrest of the President regardless of whether there is a legitimate case or not. This has created a political climate in which the judiciary is influenced by imperialist and right-wing agendas rather than evidence and fairness. 



This judgment is part of a wider pattern, as CIC has faced a series of politically motivated prosecutions in the past. He was dragged before courts on charges relating to freedom of speech and the singing of our very own struggle songs, as well as encouraging his own organisation to stand up to white racists in the case of Brackenfell.  

The EFF is therefore not surprised nor deterred by this judgment. We will engage the judgment further, seek comprehensive legal advice, and move with the attention to appeal this ruling, trusting that higher courts will expose the weaknesses and contradictions of this prosecution. We also raise serious questions about the conduct of the magistrate, particularly the acceptance of hearsay evidence that was not tested in court. Such practices undermine the fairness and integrity of judicial proceedings. 



When the state previously failed to prosecute the CIC on trumped-up charges that were dismissed, it became clear that the intention has always been to persecute him in any way possible, regardless of merits or evidence. It is even more hypocritical and proves a political agenda, that accused number two who was alleged to have handed the firearm to the CIC has been acquitted of all charges, yet the individual he is accused of handing the firearm to has been found guilty. 

This proves that this was a witch hunt to target the President of the EFF and find him guilty no matter how irrational it may be For this reason, the EFF has accepted that we must continue to fight not only political persecution but also the broader alliance of racist organisations, elements of the judiciary, and state machinery that remain in the pockets of the white establishment. 

The persecution of CIC Malema is ultimately an attack on the millions who look to the EFF as a vehicle for change. It is an attack on the poor, the landless, the workers, and the youth of this country who refuse to be silenced. We reaffirm our full support for our President and CIC, and we call on all Fighters, ground forces, and progressive South Africans to remain committed to the cause of economic freedom in our lifetime. 

The President and Commander-in-Chief, Julius Malema, will continue to demonstrate his respect for due process by availing himself for all court proceedings, including the sentencing scheduled for the 23rd of January 2026.
