ALLEGED UK FUGITIVE ENTERS INTO PLEA AND SENTENCING AGREEMENT WITH NPA
The National Prosecuting Authority (NPA) has entered into a plea and sentencing agreement, in terms of Section 105A of the Criminal Procedure Act, with alleged United Kingdom fugitive Ndodana Mkhanyisi Tshuma (46), who has pleaded guilty to offences relating to the unlawful possession of firearms and ammunition, as well as contravening the Immigration Act.
Tshuma appeared before the Johannesburg Magistrates’ Court in two separate matters. The first concerns extradition proceedings instituted following a request by the United Kingdom authorities, while the second relates to charges arising from his alleged unlawful possession of firearms and ammunition.
In terms of the plea agreement, Tshuma pleaded guilty to four charges, including Unlawful possession of a prohibited firearm with an obliterated serial number, Unlawful possession of an unlicensed firearm, Unlawful possession of ammunition and Contravention of the Immigration Act.
The court partially heard the Section 105A plea and sentencing proceedings in the firearms matter before adjourning the proceedings to allow the State an opportunity to obtain the necessary authorisation for the plea and sentencing agreement. The extradition proceedings were also postponed to 10 September 2026 for hearing.
The NPA remains committed to ensuring that all matters before the courts are prosecuted in accordance with the law and that the interests of justice are upheld.
